1. About This Document
This Terms of Use document governs the day-to-day operational use of the Puraskrit merchant platform by registered merchants. It must be read in conjunction with the Merchant Terms & Conditions and the Merchant Privacy Policy. In the event of conflict, the Merchant Terms & Conditions take precedence, followed by the Merchant Privacy Policy, and then this document.
2. Account Registration
Merchants must register with valid, accurate business details including business name, registered address, GSTIN, and authorised representative contact information. Merchants are responsible for maintaining account security and confidentiality of login credentials.
Customers registering separately on the customer-facing app must use their phone number and name. All users are responsible for any activity occurring under their account credentials.
3. Merchant Responsibilities
By registering and maintaining an active merchant account, merchants agree to:
- Maintain valid business licences and comply with all applicable laws throughout the subscription.
- Provide accurate, genuine transaction records and milestone data.
- Honour all loyalty rewards promised to customers according to the defined loyalty program rules.
- Ensure service quality consistent with local consumer protection laws, including the Consumer Protection Act, 2019.
- Avoid manipulating or falsifying transaction or milestone data.
- Provide a minimum of 30 days' advance notice to Puraskrit and affected customers before any business closure or platform exit, to allow customers to redeem earned milestones.
- Remain fully responsible for the quality of services and fulfilment of any obligations to customers.
- Promptly notify Puraskrit at support@puraskrit.com of any security breach or unauthorised access to the merchant account.
4. Customer Responsibilities
Customers who use the platform alongside merchants agree to:
- Provide accurate personal information at registration and keep it current.
- Use rewards honestly and in connection with genuine transactions only.
- Avoid fraudulent behaviour such as false transaction claims.
- Comply with all platform policies.
Customers have the right to request account deletion and data purging at any time in accordance with the Customer Privacy Policy.
5. Communications
Merchants and customers may receive notifications via push notifications or WhatsApp regarding loyalty updates, platform alerts, and billing notifications. WhatsApp communications are sent only where separate explicit consent has been provided through the applicable opt-in flow.
Merchants may opt out of non-essential promotional communications. Critical billing, security, and compliance alerts cannot be disabled while the merchant subscription is active.
6. Acceptable Use Policy
All users (merchants and customers) must not:
- Submit fake, fabricated, or duplicated transactions.
- Manipulate loyalty program data or tracking mechanisms.
- Use automated scripts, bots, or exploits to gain an unfair advantage.
- Engage in any illegal activities using the platform.
- Attempt to reverse engineer, decompile, or tamper with the platform.
- Harass, mislead, or harm other users through the platform.
7. Prohibited Businesses
Merchants may not use the Puraskrit platform to operate businesses involving:
- Illegal substances or narcotics
- Gambling or wagering operations
- Adult entertainment or services
- Fraudulent financial services or investment schemes
- Any activity prohibited under applicable Indian law
Registration by a prohibited business category will result in immediate account termination without refund.
8. Content Policy
Merchants may upload images, service descriptions, and business information. All content uploaded must:
- Be accurate, truthful, and not misleading.
- Comply with applicable law and not be harmful, offensive, or defamatory.
- Not infringe any third-party intellectual property rights.
Puraskrit reserves the right to remove non-compliant content without notice and to suspend merchant accounts that repeatedly upload prohibited content.
9. Intellectual Property
All platform software, systems, algorithms, and branding are the intellectual property of Asraubh Private Limited. Merchants may not copy, distribute, reverse engineer, or create derivative works from the platform. Merchants retain ownership of their own uploaded business content and grant Puraskrit a limited licence to display it for platform operation purposes only.
10. Refund Policy & Fair Service
Puraskrit does not currently process payments for merchant services. Refunds for merchant services must be handled directly between merchants and their customers.
Puraskrit enforces a Fair Service Policy: if a merchant repeatedly refuses legitimate customer refunds or fails to honour services tied to earned loyalty milestones, Puraskrit reserves the right to suspend or terminate the merchant's account after issuing a written warning and allowing a 14-day cure period.
11. Warranty Disclaimer
THE PURASKRIT PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ASRAUBH PRIVATE LIMITED EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PURASKRIT DOES NOT WARRANT THAT THE PLATFORM WILL BE CONTINUOUSLY AVAILABLE OR ERROR-FREE.
12. Account Suspension & Termination
For serious violations including fraud, illegal activity, prohibited business category, or severe platform abuse, Puraskrit may terminate a merchant account immediately without prior notice.
For non-fraudulent first-time violations, Puraskrit will issue a written warning and allow 14 days to remedy the violation before taking further action.
Merchants who are terminated for reasons other than fraud or policy violation are entitled to a pro-rata refund of any prepaid, unused subscription fees.
13. Force Majeure
Puraskrit shall not be held responsible for any failure or disruption to platform services resulting from events beyond its reasonable control, including natural disasters, government actions, cyberattacks, internet outages, or infrastructure failures.
14. Severability
If any provision of these Terms of Use is found to be invalid or unenforceable, it shall be modified to the minimum necessary extent or severed. All remaining provisions shall continue in full force and effect.
15. Governing Law
These Terms of Use are governed by the laws of India. Subject to the arbitration clause in the Merchant Terms & Conditions, all disputes shall be subject to the exclusive jurisdiction of courts located in Bengaluru, India.
