1. About This Document
This Terms of Use document governs your day-to-day use of the Puraskrit customer application. It must be read in conjunction with the Customer Terms & Conditions and the Customer Privacy Policy. In the event of any conflict, the Customer Terms & Conditions shall take precedence, followed by the Customer Privacy Policy, and then this document.
2. Account Registration
Customers must register using a valid phone number and name. Users are responsible for maintaining account security and confidentiality of their login credentials. Puraskrit is not liable for any loss or damage arising from unauthorised access to your account where you have failed to maintain the security of your credentials.
Only individuals aged 18 and above may register. If you are under 18, you must not create an account.
3. Customer Responsibilities
While using the Puraskrit app to track and redeem your loyalty milestones, you agree to:
- Provide accurate personal information at registration and keep it up to date.
- Use rewards honestly and only in connection with genuine transactions.
- Avoid fraudulent behaviour, including false transaction claims or manufacturing fake milestones.
- Comply with all platform policies, including this document, the Terms & Conditions, and the Privacy Policy.
- Notify Puraskrit promptly if you become aware of any unauthorised use of your account.
You have the right to request account deletion and data purging at any time in accordance with the Customer Privacy Policy. To submit such a request, contact support@puraskrit.com.
4. Communications
You may receive notifications via push notifications or WhatsApp regarding loyalty updates, milestone rewards, and important platform notifications.
WhatsApp communications will only be sent where you have provided separate, explicit consent for WhatsApp messaging during the app's onboarding flow. You may opt out of promotional notifications at any time via your account settings. Critical account-related notifications (e.g., account security alerts, data breach notifications) cannot be turned off while your account is active.
Consent for push notifications and WhatsApp communications are managed independently. Opting out of one channel does not affect the other.
5. Acceptable Use Policy
To maintain a fair and trustworthy ecosystem for all users and merchants, you must not:
- Submit fake, fabricated, or duplicated transactions to accumulate milestones.
- Manipulate or interfere with loyalty program data or tracking mechanisms.
- Use automated scripts, bots, or other tools to exploit the system or gain an unfair advantage.
- Engage in any illegal activities using the platform.
- Attempt to reverse engineer, decompile, or tamper with the platform's software or infrastructure.
- Harass, mislead, or harm other users or merchants through the platform.
Violation of this Acceptable Use Policy may result in account suspension, termination, or referral to appropriate authorities.
6. Content Policy
Merchants may upload images, service descriptions, and business information. As a customer, if you upload a profile photo, it must:
- Be a genuine representation (not impersonation of another person).
- Not contain illegal, offensive, misleading, or harmful content.
Puraskrit reserves the right to remove any content that violates this policy without notice.
7. Intellectual Property
All platform software, branding, and content developed by Asraubh Private Limited are the intellectual property of Asraubh Private Limited. You may not copy, reproduce, distribute, or reverse engineer the platform or its components.
You retain ownership of any profile content you upload. By uploading content, you grant Puraskrit a limited licence to display it solely for the purpose of operating your account.
8. Warranty Disclaimer
THE PURASKRIT PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASRAUBH PRIVATE LIMITED MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PURASKRIT DOES NOT WARRANT THAT THE PLATFORM WILL BE CONTINUOUSLY AVAILABLE, ERROR-FREE, OR FREE OF SECURITY VULNERABILITIES.
9. Account Suspension & Termination
For serious violations including fraud, illegal activity, or severe platform abuse, Puraskrit may suspend or terminate your account immediately without prior notice.
For first-time or non-fraudulent policy violations, Puraskrit will issue a written warning and provide a 14-day cure period to remedy the violation before taking further action.
Upon account termination, any unredeemed milestones associated with the account will be forfeited. If termination results from a platform error (not a user violation), Puraskrit will make reasonable efforts to restore your data.
10. Force Majeure
Puraskrit shall not be held responsible for any failure or disruption to platform services resulting from events beyond its reasonable control, including natural disasters, government actions, cyberattacks, internet outages, or infrastructure failures.
11. Severability
If any provision of these Terms of Use is found to be invalid, unlawful, or unenforceable by a competent authority, that provision shall be modified to the minimum extent required to make it valid, or severed if modification is not possible. All remaining provisions shall continue in full force and effect.
12. Governing Law
Your use of the Puraskrit customer application and these Terms of Use are governed by the laws of India. Subject to the arbitration clause in the Customer Terms & Conditions, all disputes shall be subject to the exclusive jurisdiction of courts located in Bengaluru, India.
